TARK – Terms of Service

1. About TARK

“TARK” (“we”, “our”, or “us”) is operated by TARK LLC, a single-member limited liability company. These Terms of Service (“Terms”) govern your access to and use of the TARK mobile application, website, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old, or use the Service with the involvement and consent of a parent or legal guardian, where permitted by law. You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations.

3. Account Access & SMS One-Time Passwords (OTP)

TARK uses SMS-based one-time passwords (“OTP”) to authenticate users and protect account access.

• Transactional use only: SMS messages are sent solely for login, account verification, and security purposes.
• User-initiated: Messages are sent only when you explicitly request a verification code within the app.
• Frequency: Typically one message per login attempt. Additional messages may be sent if you retry.
• Charges: Standard message and data rates may apply.
• Confidentiality: You must not share OTP codes with anyone.
• Opt-out: You may opt out of SMS messages by replying STOP. Opting out may prevent you from accessing or using certain features of the Service. Reply HELP for assistance.

TARK does not send marketing or promotional messages via SMS.

Biometric Authentication: After your initial sign-on using OTP verification, the app offers the option to enable biometric authentication (such as fingerprint, Face ID, or other device-provided authentication methods) for subsequent logins. If you enable this feature, your device's biometric data is used locally on your device to authenticate you. We do not collect, store, or process your biometric data on our servers—authentication is handled entirely by your device's operating system. You can disable biometric login at any time in your device settings or app settings.

4. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information:

5. Acceptable Use

You agree not to:

• Harass, threaten, impersonate, or abuse other users
• Post or transmit illegal, harmful, or infringing content
• Attempt unauthorized access to accounts, systems, or networks
• Abuse authentication systems (including OTP misuse or automation)
• Scrape, reverse engineer, or disrupt the Service
• Use the Service for spam or fraudulent activity

Violation of these rules may result in suspension or termination.

6. Community Features & User Content

The Service may allow users to create, share, or exchange content (including messages, schedules, posts, or other materials) (“User Content”).

• You retain ownership of your User Content.
• You grant TARK LLC a limited, non-exclusive, worldwide license to host, store, display, and transmit User Content solely to operate and improve the Service.
• TARK may remove content or restrict access if it violates these Terms or applicable law.

7. In-Person Activities & Safety

TARK helps users coordinate sports-related activities and social interactions. Participation in any activity arranged through the Service is at your own risk.

TARK LLC does not verify users beyond authentication, supervise activities, or assume responsibility for injuries, disputes, or damages arising from user interactions.

8. Service Availability

The Service is provided on an “as is” and “as available” basis. We may modify, suspend, or discontinue any part of the Service at any time without notice.

9. Termination

TARK LLC may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms, misused the Service, or created legal or security risk. You may stop using the Service at any time.

10. Disclaimers & Limitation of Liability

To the fullest extent permitted by law:

• TARK LLC disclaims all warranties, express or implied.
• TARK LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the Service.

11. Changes to These Terms

We may update these Terms periodically. The “Last Updated” date reflects the most recent revision. Continued use of the Service after changes means you accept the updated Terms.
